From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for the Breaker Bay rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement, there could be an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they reside in. If the property manager is unable to provide the necessary information within 21 days of having received the inquiry, they may be issued an infringement notice and be fined upto $750.

In addition, there is also a fine of approximately $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the one who is identified on the tenancy contract as the person letting the property out, so it could be the name of the landlord or the property management company.

All information in the Statement of Compliance needs to be current when the tenancy agreement is signed. It should be kept updated throughout the duration of the tenancy when any related work is completed.

It is also crucial to remember that landlords who have multiple rental properties may receive greater penalties for non-compliance. The most severe penalties are reserved for the most serious violations. Those who have six or more properties can be fined as high as $50,000 and as high as $100,000 in the case of hearing claims.

Clearly, failure to meet your Healthy Homes requirements can hit your bank account with massive fines as well as still being required to adhere to the regulations. Don’t take a chance with your rental property Contact us now and ask us to conduct a house assessment done for your rental property.

Unreasonable Gaps & Holes

Draught Stopping Breaker Bay

Draughts may lead to lower temperatures in homes. A damp house will cost more to heat, which results in wasting money and energy.

If a draft can be perceived as a result of gaps or holes that it requirements to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see a clear draught from a hole or gap that is, it’s most likely a gap or hole that requirements sealing in the way you can. Cracks and gaps that are large should be sealed permanently. Any gaps greater than 3mm that allow air to enter or exit within your home require to be sealed. For instance, if an open fireplace is not in use, it could cause draughts, and should be shut off. Landlords and property managers are accountable for making sure such draughts are eliminated whenever possible.

You don’t need to block up intentional gaps or holes which are part of the construction. For example, tiny gaps around doors and windows could be necessary to allow movement of the building when the house is heated and cools so that they are able to be shut and opened, rather than securing. We will examine all doors and windows in the Healthy Homes assessment of your rental property.

Proper heating is crucial to ensure well-being houses

Heating Breaker Bay

Breaker Bay rental properties need to have a stable source of heating that can warm the largest or main living space to a minimum of 18 degrees Celsius, even on the coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs to remain fixed (i.e., not portable) and at least 1.5 Kilowatts in heating capacity and have the minimum capacity for heating required for the main living room. A Heating Assessment Tool may be used to check if your current fix heater(s) are sufficient or whether you will require to "top-up" by adding a second heater. Fires that are open and unflued heaters, such as mobile LPG bottle heaters are not considered to be acceptable heating options for The Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump then it must include a thermostat. This makes the heating more reliable and effective. For most homes, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are required. In certain situations, such as small apartments, a smaller fixed electric heater could be enough.

If the main living room already has a permanent heating source, like a heat pump, then it could require some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the quality as they are either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Breaker Bay

Every living space of the rental property should have at least one opening windows or an exterior door to offer natural ventilation. In addition, humid areas like kitchens and bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.

This ventilation quality is about recognising that dry air will be less difficult to heat, and that an apartment that is well-ventilated is less likely to be a victim of damp and mould.

Living rooms, bedrooms, kitchens, and dining rooms are all considered living spaces. Spaces that connect, such as the hallway aren’t living spaces and therefore are not require an opening window or door.

Each window, door or the skylight needs to be able open to the outside, but remain closed in order to allow the circulation of fresh air and air flow.

Bathrooms, kitchens, as well as any other space in your property with a bath, shower cooker or any other moisture generating item will need appropriate extractor fans that vent towards the outside. We offer a Healthy Homes Assessment service will make sure there is sufficient air circulation in every living space and will also check for the proper extractor fans in areas of high moisture.

Insulation Breaker Bay

Ceiling and underfloor insulation has been compulsory to all rental homes from 1 July 2019. All landlords and property managers should make sure the insulation meets current quality. In some instances, current ceiling insulation, or the insulation of the sub floor space may require to be topped up or replaced.

A well-insulated house will reduce the risk of condensation and reduce the chances of mould and damp, and will also make an easier task to allow the household to hold the heat.

Insulation requirements to meet the R-values for your area

The "R" signifies thermal resistance, and it is a measurement of how well the insulation withstands heat flow. The more R-value is higher, the better the insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – the remainder of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 below floor R 1.3

Breaker Bay Moisture Ingress & Drainage

Making sure your rental property is protected from water damage isn’t only about the inside of the building It’s about having to ensure there is somewhere for rain, surface or ground water, and stop it from coming into the building. When it is about damp and water, it’s frequently the things you don’t notice that can become a big problem and end up causing damage to your investment and affecting your tenant’s health.

Rental properties require to have efficient drainage to remove the stormwater and surface waters, and groundwater, with an appropriate runoff or outfall. Making sure that the water has a location to go, and also that it isn’t allowed to remain beneath structures is an crucial aspect of keeping your property dry.

In addition to the drainage system that will prevent the ingress of moisture, if your property has an enclosed space between floorboards and ground, a ground moisture barrier must be installed if it’s reasonably practicable to do so.

The ground-moisture barrier generally a polythene sheet laid over the ground to prevent any moisture from the ground from entering the property. It also helps prevent from causing damage to the flooring insulation.
