Fines for Failing to Comply
Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on a Johnsonville rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.
Since the 1st July of 2021, when a new, renewed or varied lease is entered into on the Johnsonville rental property, all Healthy Homes compliance work must be taken care of within 90 days.
Failure to adhere to each of Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.
Anyone can request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the property manager does not provide the necessary information within 21 days from being informed of the request, they can be issued an infringement notice and be fined up to $750.
In addition, there’s an additional fine of approximately $900 for landlords and property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person who is liable to pay this fine is the one who is listed on the tenancy contract as the person renting the property which could be the name of the landlord, or the company that manages the property.
All the information on the Compliance Statement needs to be current before the tenancy agreement can be signed, and ideally it must be updated throughout the tenancy as any associated work has been completed.
It is crucial to be aware that a landlord who have several rental properties can face even higher fines for non-compliance. The most severe penalties are reserved for the most serious breaches, and landlords with at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.
